THCA Laws in Washington β€” Full Breakdown

Washington's Liquor and Cannabis Board (LCB) formally requires any product exceeding 0.3% total THC to be sold through licensed marijuana retailers. Commercial THCA flower exceeds this threshold and has no compliant pathway in general hemp retail.

Washington was one of the first states to legalize recreational cannabis in 2012 and has one of the most established cannabis markets in the United States. Licensed cannabis retailers are widespread throughout the state, providing legal access to THCA flower through the dispensary channel.

For THCA flower, Washington's licensed cannabis retail network is the compliant channel. Non-intoxicating CBD hemp products remain available outside the cannabis framework.

What Is THCA and Why Does Legality Matter?

THCA (tetrahydrocannabinolic acid) is the raw, non-psychoactive form of THC found in fresh cannabis. Under the 2018 Farm Bill, hemp plants containing ≀0.3% delta-9 THC by dry weight are federally legal β€” regardless of THCA content. When THCA is smoked or vaped, heat converts it to psychoactive delta-9 THC through a process called decarboxylation.

Some states have added "total THC" standards that count THCA toward the THC limit. Others have banned smokable hemp specifically. The legal status of THCA varies by state and is subject to change as legislatures continue to address hemp regulations.
