THCA Laws in Texas β€” Full Breakdown

Texas had been one of the largest states for hemp-derived THCA flower, with a massive retail market built under HB 1325 (2019). DSHS rules applying a total THC testing formula took effect March 31, 2026 and ban THCA flower from retail sale. Cannabinoid vapes were banned September 1, 2025.

Under the DSHS total THC formula, commercial THCA flower is non-compliant and has no lawful retail pathway in the hemp channel. Industry groups have challenged the DSHS rules administratively.

Texas has no recreational marijuana. Governor Abbott had vetoed Senate Bill 3 in June 2025 calling it 'flawed,' and the 2026 legislative session may revisit the issue. As of the DSHS rules' effective date, high-THCA hemp flower is banned from retail sale.

What Is THCA and Why Does Legality Matter?

THCA (tetrahydrocannabinolic acid) is the raw, non-psychoactive form of THC found in fresh cannabis. Under the 2018 Farm Bill, hemp plants containing ≀0.3% delta-9 THC by dry weight are federally legal β€” regardless of THCA content. When THCA is smoked or vaped, heat converts it to psychoactive delta-9 THC through a process called decarboxylation.

Some states have added "total THC" standards that count THCA toward the THC limit. Others have banned smokable hemp specifically. The legal status of THCA varies by state and is subject to change as legislatures continue to address hemp regulations.
