THCA Laws in Tennessee β€” Full Breakdown

Tennessee passed SB 1413 and HB 1376 in 2024, and the Tennessee Department of Agriculture issued permanent rules effective December 26, 2024 banning hemp products with THCA exceeding 0.3% by dry weight. This was a direct attempt to shut down the state's large THCA flower market.

Despite the formal ban, major hemp operators continue to ship THCA flower to Tennessee customers. The Tennessee Growers' Coalition filed a lawsuit to block the THCA flower ban, and that litigation is ongoing. Enforcement against interstate hemp shipments has been limited while legal challenges proceed.

Tennessee does not have recreational marijuana. The practical market reality as of 2025-2026 is that THCA flower remains available to Tennessee consumers through online hemp operators, even as the state's formal regulatory position is to ban it. The legal outcome of the Growers' Coalition lawsuit may change the landscape.

What Is THCA and Why Does Legality Matter?

THCA (tetrahydrocannabinolic acid) is the raw, non-psychoactive form of THC found in fresh cannabis. Under the 2018 Farm Bill, hemp plants containing ≀0.3% delta-9 THC by dry weight are federally legal β€” regardless of THCA content. When THCA is smoked or vaped, heat converts it to psychoactive delta-9 THC through a process called decarboxylation.

Some states have added "total THC" standards that count THCA toward the THC limit. Others have banned smokable hemp specifically. The legal status of THCA varies by state and is subject to change as legislatures continue to address hemp regulations.

All Leaflyx products are federally compliant hemp with COA documentation.
