THCA Laws in South Dakota β Full Breakdown
South Dakota enacted legislation in 2024 that prohibits the manufacture and sale of chemically modified cannabinoids in the hemp market. The law also applies a total THC standard β counting THCA toward the 0.3% hemp threshold β which disqualifies commercial THCA flower from the state's hemp program.
Delta-8, delta-10, HHC, THC-O, and THCA flower are all prohibited from general retail. Only non-intoxicating CBD products that remain below total THC limits are permitted. The regulatory environment is restrictive for the broader hemp cannabinoid market.
South Dakota does not have recreational marijuana. The medical marijuana program exists but does not provide a widely accessible alternative for THCA flower. The hemp-channel THCA market is effectively closed.

What Is THCA and Why Does Legality Matter?
THCA (tetrahydrocannabinolic acid) is the raw, non-psychoactive form of THC found in fresh cannabis. Under the 2018 Farm Bill, hemp plants containing β€0.3% delta-9 THC by dry weight are federally legal β regardless of THCA content. When THCA is smoked or vaped, heat converts it to psychoactive delta-9 THC through a process called decarboxylation.
Some states have added "total THC" standards that count THCA toward the THC limit. Others have banned smokable hemp specifically. The legal status of THCA varies by state and is subject to change as legislatures continue to address hemp regulations.
All Leaflyx products are federally compliant hemp with COA documentation.
