THCA Laws in Minnesota β€” Full Breakdown

Minnesota's total THC law counts THCA toward the 0.3% hemp limit, disqualifying commercial THCA flower from the hemp product category. Under HF 100, the state established the Office of Cannabis Management to oversee a regulated cannabis market. Hemp edibles are limited to 5mg THC per serving and 50mg per package in the unregulated channel.

Recreational cannabis became legal in Minnesota in 2023, and THCA flower is fully legal for adults 21 and older when purchased through a licensed cannabis dispensary. The state has built regulatory infrastructure for its adult-use market.

The practical effect is that THCA flower exists as a legal product in Minnesota β€” just not through the hemp channel. Licensed dispensaries provide a legal and regulated source. If you are in Minnesota, a licensed cannabis retailer is the appropriate and compliant way to purchase THCA flower.

What Is THCA and Why Does Legality Matter?

THCA (tetrahydrocannabinolic acid) is the raw, non-psychoactive form of THC found in fresh cannabis. Under the 2018 Farm Bill, hemp plants containing ≀0.3% delta-9 THC by dry weight are federally legal β€” regardless of THCA content. When THCA is smoked or vaped, heat converts it to psychoactive delta-9 THC through a process called decarboxylation.

Some states have added "total THC" standards that count THCA toward the THC limit. Others have banned smokable hemp specifically. The legal status of THCA varies by state and is subject to change as legislatures continue to address hemp regulations.

All Leaflyx products are federally compliant hemp with COA documentation.
