THCA Laws in Michigan β€” Full Breakdown

Michigan's definition of THC includes THCA, meaning hemp-derived THCA flower is classified as marijuana under state law. The Cannabis Regulatory Agency has increased enforcement actions against unlicensed THCA sellers, treating them as illegal marijuana retailers.

The Michigan Senate passed legislation in December 2025 to formally incorporate intoxicating hemp products β€” including THCA flower β€” into the licensed marijuana system. This formalizes what has already been the CRA's enforcement position and creates a clearer regulatory pathway through licensed dispensaries.

Recreational cannabis is legal in Michigan following the passage of Proposal 1 in 2018. Licensed CRA-licensed dispensaries legally sell THCA flower as a cannabis product. Online hemp vendors shipping THCA flower to Michigan addresses face enforcement risk. If you are in Michigan, a licensed dispensary is the only legal channel.

What Is THCA and Why Does Legality Matter?

THCA (tetrahydrocannabinolic acid) is the raw, non-psychoactive form of THC found in fresh cannabis. Under the 2018 Farm Bill, hemp plants containing ≀0.3% delta-9 THC by dry weight are federally legal β€” regardless of THCA content. When THCA is smoked or vaped, heat converts it to psychoactive delta-9 THC through a process called decarboxylation.

Some states have added "total THC" standards that count THCA toward the THC limit. Others have banned smokable hemp specifically. The legal status of THCA varies by state and is subject to change as legislatures continue to address hemp regulations.
